Introduction & Acceptance

Hostacks Ltd (“Hostacks”, “we”, “our”, “us”) is a UK limited company (Company Number: 14706886) providing web hosting, VPS, dedicated servers, WordPress hosting, proxy servers, cloud storage, and related services. By accessing, browsing, or using our website, Android, or iOS applications (collectively “Services”), you agree to be bound by these Terms of Service (“TOS”). These TOS govern your use of all Hostacks services, including any new features, products, or updates that may be introduced. If you do not agree to these TOS, you must not use our Services. Continued use constitutes acceptance of all updates and amendments.

Definitions

“User”, “you”, or “your” refers to any individual or entity who accesses or uses Hostacks Services. “Services” include all hosting products, cloud storage, dedicated servers, VPS, proxy servers, mobile applications, and related software provided by Hostacks. “Content” refers to any data, files, websites, software, or other materials uploaded, transmitted, or created by users through Hostacks Services. “Account” is the registered user profile required to access our services. Understanding these definitions helps ensure clarity regarding rights, responsibilities, and limitations while using our Services.

Eligibility & Registration

You must be at least 18 years old to register and use Hostacks Services. Minors under 18 are not permitted to use our services under any circumstances. During registration, you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials. Accounts are for individual or business use only and may not be shared, resold, or transferred without written consent from Hostacks. Providing false information may result in termination of your account.

User Responsibilities & Data Security

Users are fully responsible for all activity under their account, including login credentials, content uploaded, and interactions with our Services. Hostacks provides optional backup services, but users remain fully responsible for their data. Users must comply with all applicable laws and ensure their content does not infringe third-party rights. Secure passwords and up-to-date software are required to protect accounts from unauthorized access. Hostacks will notify users of critical updates, but ultimate responsibility for data protection and secure usage rests with the user. In case of accidental deletion or failure to backup, Hostacks cannot be held liable for loss of data.

Services & Service Levels

Hostacks provides a range of services with specific guarantees and optional features: Web Hosting & WordPress Hosting: Includes a 30-day money-back guarantee, optional daily or weekly backups, 99.9% uptime guarantee, and scalable storage. VPS Hosting: Includes 24-hour money-back guarantee, optional snapshot backups, 99.9% uptime SLA, and monitoring tools. Dedicated Servers: Includes 24-hour money-back guarantee, dedicated resources, optional monitoring services, and uptime SLA. Cloud Storage: Optional data backup, user responsible for sensitive data, scalable storage options. Proxy Services: Must comply with all applicable laws and cannot be used for illegal activity. Hostacks reserves the right to modify services, add new features, or discontinue services with prior notice.

Payments, Billing, & Currencies

Hostacks supports multiple currencies including GBP (Europe), USD (USA), and local currencies depending on your country. Supported payment methods include PayPal, Credit/Debit Cards, Cryptocurrency, and Bank Transfers. All services are subject to automatic renewal unless cancelled before the renewal date. Failure to pay invoices results in account suspension after 3 days and deletion of the service after 15 days. Users are responsible for any transaction fees or currency conversion charges applied by payment processors. Payment gateways such as PayPal and Stripe will respect these TOS and refund policies when used for payments, but platform-specific rules may apply.

Refund Policy

Hostacks provides different refund periods depending on the product: Web Hosting & WordPress Hosting: 30-day money-back guarantee. VPS, Dedicated Servers, Proxy Services, and Cloud Storage: 24-hour full refund only. Setup fees, promotional offers, and discounted services are non-refundable. Partial refunds may be issued as account credits, which are non-transferable and cannot be redeemed for cash. Refunds are generally processed using the original payment method, subject to applicable payment gateway rules. Users are encouraged to contact support immediately if they request a refund within the applicable period.

Prohibited Activities

Users are strictly prohibited from using Hostacks Services for illegal, harmful, or abusive activities, including but not limited to: hosting malware, viruses, phishing tools, or content violating intellectual property laws; engaging in fraud, hacking, or unauthorized cryptocurrency mining; spamming, DDoS attacks, or unsolicited advertising; accessing other user accounts or Hostacks systems without authorization. Violation of these rules may result in immediate suspension or termination, without refund beyond the stated refund policy.

Service Guarantees & Limitations

Hostacks strives to maintain a 99.9% uptime on all services. However, no system is completely free from interruption, and Hostacks does not guarantee uninterrupted service. Backup services must be activated by the user to ensure data safety. Hostacks is not responsible for indirect, incidental, or consequential damages, including lost profits, business interruption, or loss of data. Free backups are only provided if users activate the service. Hostacks may perform maintenance or updates that may temporarily interrupt services, with prior notice whenever possible.

Termination & Suspension

Hostacks reserves the right to suspend or terminate accounts for TOS violations, non-payment, or illegal activity. Notice is usually provided, but immediate termination may occur in severe or urgent cases. Upon termination, users lose access to the service and any non-refunded fees beyond the stated refund policy. Users remain responsible for outstanding balances or contractual obligations. Termination does not limit Hostacks’ legal rights to recover damages for violations or abuse of services.

Mobile Applications

These TOS apply to both Android and iOS applications. All in-app purchases and renewals are subject to these TOS. Users must also comply with platform rules set by Google Play Store and Apple App Store. Refunds for in-app purchases may be subject to additional restrictions imposed by the platform. Hostacks may update app features, permissions, or data collection practices, with notifications sent to users through the app or email.

Changes to Terms

Hostacks may modify these TOS at any time. Users will be notified via email and/or in-app notifications of any material changes. Continued use of services after updates constitutes acceptance of the modified TOS. It is the user’s responsibility to review the TOS periodically to stay informed of changes.

Limitation of Liability & Disclaimer

Hostacks is not liable for indirect, incidental, or consequential damages, including but not limited to lost profits, business interruption, or data loss. Services are provided 'as is' without any warranties except those explicitly stated. Users are solely responsible for maintaining their data, backups, security, and compliance with all applicable laws and regulations. Hostacks shall not be held liable for damages resulting from improper use of services or failure to comply with these TOS.

Data Protection & Privacy

Hostacks respects your privacy and handles all personal data in accordance with our Privacy Policy. Users agree that Hostacks may collect, store, and process information necessary to deliver services. Users must comply with GDPR and other applicable data protection regulations. Hostacks implements reasonable security measures but cannot guarantee absolute security. Users are responsible for securing their own data, passwords, and devices.

Force Majeure

Hostacks is not liable for delays, failures, or interruptions caused by events beyond our reasonable control, including natural disasters, internet failures, network outages, or other unforeseen events. Hostacks will make reasonable efforts to resume services as soon as possible.
